For Job Candidates

• Resume/CV review and consultation
• Interview preparation and coordination
• Career development guidance
• Confidential job search services
• Salary negotiation support
• Access to exclusive job opportunities

3. User Accounts and Registration

Account Creation

To access certain Services, you may need to create an account by providing:

• Accurate and complete information
• Valid contact details
• Professional credentials (for candidates)
• Company information (for employers)

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains current and accurate

Account Restrictions

You may not:

• Create multiple accounts for the same individual or company
• Use false or misleading information
• Impersonate another person or entity
• Share account credentials with unauthorized parties

4. Service Terms for Employers

Engagement Terms

By engaging our recruitment services, employers agree to:

• Provide accurate job descriptions and requirements
• Respond to candidate submissions in a timely manner
• Conduct fair and non-discriminatory hiring practices
• Honor agreed-upon recruitment fees and payment terms
• Maintain confidentiality of candidate information
• Use candidate data solely for recruitment purposes

Recruitment Fees

• Fee structure will be outlined in separate Service Agreements
• Standard fees range from 15-30% of annual salary depending on position level
• Payment terms: Within 30 days of invoice date
• Replacement guarantee period as specified in Service Agreement

Exclusive and Non-Exclusive Arrangements

• Terms of exclusivity defined in individual Service Agreements
• Non-circumvention clause applies to all candidate introductions
• Protection period of 12 months from initial introduction

5. Service Terms for Candidates

Application and Representation

By submitting your application or CV, you:

• Confirm all information provided is accurate and truthful
• Authorize us to share your information with potential employers
• Grant us permission to conduct reference checks
• Agree to notify us of any changes to your availability
• Acknowledge that we act as an intermediary, not your employer

No Fees to Candidates

Our services are free to job candidates. We do not charge any fees for:

• Job matching services
• Interview coordination
• Career consultation
• Application processing

If anyone claiming to represent Luminare Consulting requests payment from candidates, please report this immediately as it may be fraudulent.

Candidate Obligations

Candidates agree to:

• Attend scheduled interviews or provide adequate notice of cancellation
• Communicate honestly about job preferences and salary expectations
• Inform us if accepting offers from other sources
• Provide truthful information about qualifications and experience
• Respect confidentiality of client information shared during recruitment

6. Intellectual Property Rights

Our Content

All content on our Site, including but not limited to:

• Text, graphics, logos, and images
• Recruitment methodologies and assessments
• Market reports and talent insights
• Website design and functionality
• Trademarks and service marks

Is owned by or licensed to Luminare Consulting and protected by Indonesian and international intellectual property laws.

User Content

By submitting content to us (including resumes, job descriptions, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display such content for providing our Services.

Restrictions

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or logos without authorization
• Scrape or data mine our Site or candidate database
• Reverse engineer our assessment tools or methodologies

7. Acceptable Use Policy

You agree not to use our Site or Services to:

• Violate any applicable laws or regulations
• Post false, misleading, or fraudulent information
• Harass, discriminate, or harm others
• Transmit spam, malware, or malicious code
• Attempt unauthorized access to our systems
• Engage in any form of employment fraud

8. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to:

• Sharing of information with potential employers (for candidates)
• Receiving relevant communications about opportunities
• International data transfers where necessary

We comply with Indonesian Personal Data Protection Law (UU PDP) and maintain strict confidentiality standards.

9. Disclaimers and Limitations of Liability

Service Disclaimers

• We do not guarantee job placement or successful hiring outcomes
• We are not responsible for decisions made by employers or candidates
• We cannot verify all information provided by users
• Employment decisions remain the sole responsibility of employers
• Career decisions remain the sole responsibility of candidates

No Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the fees paid for specific Services
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for lost profits or opportunities
• We are not liable for actions of third parties

Recruitment-Specific Limitations

We are not liable for:

• Candidate performance after placement
• Accuracy of information provided by candidates or employers
• Employment disputes between placed candidates and employers
• Changes in job requirements or candidate availability
• Visa, work permit, or immigration issues

10. Indemnification

You agree to indemnify and hold harmless Luminare Consulting, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of applicable laws
• Your infringement of third-party rights
• Information you provide to us
• Your use of our Services

11. Replacement Guarantee

For employer clients:

• Replacement guarantee period as specified in Service Agreement
• Typically 3-6 months depending on position level
• Conditions and exclusions detailed in individual agreements
• Guarantee void if candidate termination is due to redundancy or company restructuring

12. Termination

Termination by You

You may stop using our Services at any time by:

• Closing your account through the Site
• Sending written notice to inquiry@luminareconsulting.co.id
• Withdrawing your job application (candidates)
• Canceling recruitment services per Service Agreement terms (employers)

Termination by Us

We reserve the right to:

• Suspend or terminate accounts for Terms violations
• Refuse service to any user
• Remove content that violates our policies
• Discontinue Services with appropriate notice

Effects of Termination

Upon termination:

• Your right to use the Services ceases immediately
• Obligations regarding confidentiality and data protection survive
• Accrued rights and liabilities remain unaffected
• Recruitment fees for successful placements remain due

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles.

Negotiation and Mediation

For any disputes arising from these Terms:

1. First attempt: Direct negotiation between parties (30 days)
2. Second attempt: Mediation through Indonesian Mediation Center (30 days)
3. Final recourse: Arbitration or court proceedings

Arbitration

If mediation fails, disputes shall be resolved through binding arbitration under the rules of the Indonesian National Arbitration Board (BANI) in Jakarta.

Jurisdiction

For matters not subject to arbitration, the courts of Jakarta, Indonesia shall have exclusive jurisdiction.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any Service Agreements, constitute the entire agreement between you and Luminare Consulting.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights to any successor or affiliate.

Force Majeure

Neither party shall be liable for delays or failures due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, pandemic, government actions, or labor disputes.

Confidentiality

All parties agree to maintain strict confidentiality regarding:

• Sensitive business information
• Compensation details
• Proprietary recruitment strategies
• Personal information of candidates

Non-Solicitation

For 12 months after placement, employers agree not to directly solicit or hire candidates introduced by us for other positions without our involvement.

16. Special Provisions for International Clients

For clients based outside Indonesia:

• Currency for payments: IDR or USD as agreed
• Applicable taxes and duties as per Indonesian law
• Cross-border recruitment subject to immigration laws
• Time zone for all communications: Jakarta (GMT+7)

17. Updates to Terms

We reserve the right to update these Terms at any time. Changes will be effective upon:

• Posting revised Terms on the Site
• Notification via email for registered users
• Continued use constitutes acceptance of updated Terms
